Bonny Day RVA – Participation Agreement & Waiver

This Participation Agreement & Waiver (this “Agreement”) is made and entered into as of the date set forth below by and between Bonny Day RVA, LLC, a Virginia limited liability company, and the parents or guardian(s) (hereinafter referred to as the Participant(s), who is/are the legal guardian(s) of the child or children named below. By executing this Agreement, the Participant(s) acknowledge that he/she is the legal guardian of the child or children named below.

1. Program Overview

Bonny Day RVA is a parent (or guardian)-present workspace and child playspace designed for children ages 18 months to 5 years.

  • Children engage in outdoor play while parents remain onsite

  • Participantsents may work in the designated workspace or remain near their child

  • This is a shared-responsibility environment, not a drop-off childcare program

2. Parent Presence & Supervision

  • Only the Participant(s) who have executed this Agreement may participate in the Program and a Participant must remain onsite at all times when their child is present

Participantents acknowledge:

  • They may be working, but they are still responsible for their child

  • Children must remain within designated play areas

  • Staff may intervene for safety

  • Parents shall comply with all rules and regulations for participation and conduct, which may be amended from time to time

  • Bonny Day RVA reserves the right to suspend or discontinue participation if a child’s or adult participant’s behavior presents a safety concern, significantly disrupts the program environment, or if the program determines it is unable to adequately meet a participant’s needs within the scope of the program. Whenever possible, Bonny Day RVA will work collaboratively with families to address concerns prior to removal.Bonny Day RVA reserves the right to remove a child from participation in the Program at its sole reasonable discretion, and Participants agree to comply with any such request for removal

  • Parents shall comply with all rules and regulations for participation and conduct, which may be amended from time to time

3. Assumption of Risk & Liability Waiver

By participating in the Program, parents acknowledge that outdoor and group play includes inherent risks that cannot be eliminated, including but not limited to:

  • Falls, bumps, and minor injuries and illness

  • Exposure to weather, insects, and natural elements

  • Interaction with other children and shared materials

Parents agree to:

  • Voluntarily assume all risks to themselves or their child that may be associated with participation

  • For themselves, their child and their respective heirs, successors and assigns, release, discharge and hold harmless Bonny Day RVA and its owner(s), employees, agents and contractors from any and all claims, liabilities, damages, costs and expenses, including attorney’s fees, arising out of or related to participation in the Program, except in cases of intentional conduct or gross negligence by employees or agents of Bonny Day RV

4. Health & Illness Policy

To protect all families:

Children (and Participants) may NOT attend if they have:

  • Fever within the past 24 hours

  • Vomiting or diarrhea within the past 24 hours

  • Contagious illness (e.g., flu, COVID-19, pink eye, etc.)

  • Unexplained rash or persistent cough

Bonny Day RVA reserves the right to:

  • Deny entry if a child appears unwell

  • Ask a Participant or child to leave if symptoms arise during a session

No refunds will be issued for illness-related absences.

5. Payment & Cancellation Policy

Tuition, Scheduling, & Package Policies

Bonny Day RVA offers both recurring weekly program sessions and flexible drop-in participation options. Enrollment and participation policies vary by package type.

Recurring Weekly Sessions (Tuesday and Thursday cohorts) are purchased as a 6-week session package at a tuition rate of $370 per child. Participants attend the same scheduled weekly time slot each week throughout the session term. Tuition reserves a participant’s place within a limited-capacity cohort and is not based on attendance. Designated contingency/make-up dates for weather-related closures or other unforeseen circumstances are built into the program calendar and considered part of the scheduled session. Refunds, credits, or prorated tuition will not be provided for missed sessions, participant absences, or inability to attend scheduled contingency dates.

Flexible participation options are currently offered for eligible Wednesday and Friday sessions and may be used within three (3) months of purchase unless otherwise specified by Bonny Day RVA. Current package options include:

• Single Session: $75
• 3-Session Package: $210 ($70/session)
• 6-Session Package: $390 ($65/session)

Flexible session packages are non-transferable and non-refundable except where otherwise required by law. Unused sessions expire at the conclusion of the applicable usage period.

Bonny Day RVA reserves the right to modify program schedules, session structures, package offerings, eligible usage dates, operating procedures, or enrollment models as reasonably necessary for program operations, safety, enrollment needs, weather considerations, or evolving community needs. Any material changes will be communicated to participating families in advance whenever reasonably possible.

  • Sessions must be paid in advance

  • Registration secures your recurring weekly spot

Cancellations:

  • Cancellations made 24 hours in advance may receive a credit

  • No refunds for missed sessions

  • No make-ups unless explicitly offered within a session buffer period (i.e. severe weather)

Weather:

Bonny Day RVA reserves the right to modify, delay, reschedule, or cancel programming due to weather or other safety-related concerns at its sole reasonable discretion. Families will be notified of weather-related closures or schedule changes via email, text message, and/or the program’s designated communication platform.

Bonny Day RVA reserves designated make-up days for weather-related closures (lightning, extreme temperatures, unsafe air quality, unsafe road quality). These make-up days are considered part of the scheduled session. No refunds, credits, or rescheduling will be offered for participant absences during make-up days.

6. Outdoor Play Policy

Bonny Day RVA operates as an all-weather outdoor program, with the exception of dangerous conditions (e.g., lightning, extreme temperatures, unsafe air quality, unsafe road quality).

Parents agree to:

  • Dress children appropriately for the weather

  • Provide seasonal gear (rain boots, coats, sun protection, etc.)

Weather-based discomfort is not grounds for refunds.

7. Behavior Expectations

To maintain a safe and positive environment:

Parent(s)/Guardian(s) agree to disclose any relevant medical conditions, allergies, medications, developmental, behavioral, emotional, or support needs that may impact the child’s participation, safety, or experience at Bonny Day RVA, and to promptly update the program regarding any changes to this information.

  • Children must be able to participate safely in a group setting. 

  • Bonny Day RVA is a shared community environment—adults are expected to engage respectfully, remain present, and contribute to a calm, welcoming atmosphere for all.

  • Bonny Day RVA is committed to inclusion and welcomes children with a range of abilities, developmental differences, and disabilities. We will make reasonable accommodations to support participation whenever possible. Families are encouraged to share any relevant information about their child’s needs so we can work together to create a positive and safe experience for all.

Families are responsible for providing all snacks, drinks, and personal care items for their child, including:

  • Diapers and wipes (if applicable)

  • A full change of clothes

  • Weather-appropriate clothing (layers, rain gear, sun protection, etc.)

Allergies & Food Safety:
Bonny Day RVA is a shared environment, and while we encourage families to be mindful of common allergens (such as peanuts and tree nuts), we cannot guarantee an allergen-free space.

  • Children must be supervised while eating

  • Food should not be shared between children

  • Parents are responsible for managing their child’s dietary needs and allergies

 

8. Authorized Adults & Check-In

  • Only Participants may attend with a child

  • Identification may be required at check-in Families must notify Bonny Day RVA in advance of any changes

  • Upon purchase, parents and guardians will receive a welcome email containing a link to complete the Bonny Day RVA Enrollment Form. This form must be completed prior to your child's first session and includes emergency contact information, medical/allergy disclosure, authorized adults, and photo & media consent.

 

Children may not be dropped off without a Participant under any circumstances.

9. Emergency Medical Authorization

In the event of an emergency:

  • Staff may call emergency services (911)

  • Participants onsite will be notified immediately

  • If a Participant is unable to respond, staff may act in the best interest of the child

Parents agree to assume financial responsibility for any medical care provided.
